1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Aquamine Drilling Limited's ("Company", "we", "our", "us") website, services, and products. By accessing our website at aquaminedrilling.co.ke or engaging our services, you agree to be bound by these Terms.

IMPORTANT: These Terms constitute a legally binding agreement between you and Aquamine Drilling Limited. If you do not agree with any part of these Terms, you must not access our website or use our services.

Any individual or entity that engages our services, whether through our website, email, phone, or in-person consultation.
Services
All water-related services provided by Aquamine Drilling Limited as listed in Section 4.
Project
A specific service engagement between the Client and the Company.
Quotation
A formal price estimate provided by the Company for specific services.
Contract
A signed agreement between the Client and Company detailing services, timelines, and costs.

Aquamine Drilling Limited is a private company registered under the Kenya Companies Act (Cap. 2015), officially incorporated on March 28, 2023.

We maintain all necessary licenses and certifications including:

  • NEMA Environmental Compliance License
  • Water Resources Authority (WRA) Drilling Authorization
  • Geological Society of Kenya (GSK) Membership
  • KRA Tax Compliance Certificate

5. Service Engagement Process

5.1
Initial Consultation

All service engagements begin with a free initial consultation to understand project requirements, location specifics, and client expectations.

5.2
Site Assessment

Our certified hydrogeologists conduct on-site assessments to determine feasibility and prepare detailed survey reports.

5.3
Permitting Process

We handle all necessary permits including WRA authorization and NEMA EIA licensing on behalf of the client.

5.4
Quotation and Contract

Detailed quotations are provided for approval. Upon acceptance, a formal contract is signed outlining scope, timeline, and payment terms.

6. Pricing and Payment Terms

6.1
Quotations

All quotations are valid for 30 days from issue date. Prices are subject to change based on market conditions and project specifics.

6.2
Payment Schedule

Standard payment terms:

  • 50% deposit upon contract signing
  • 40% upon commencement of drilling
  • 10% upon project completion and handover
6.3
Accepted Payment Methods

We accept:

  • Bank transfers (provide account details in invoice)
  • Mobile money (M-Pesa)
  • Cheques (subject to clearance)
  • Cash (with official receipt)

7. Warranties and Guarantees

Service Guarantees:
  • Workmanship Warranty: 12 months on all drilling and installation work
  • Equipment Warranty: As per manufacturer specifications
  • Yield Guarantee: Based on hydrogeological survey estimates
  • Permit Guarantee: Full assistance in obtaining all required permits
7.1
Limitations

Warranties do not cover:

  • Damage caused by client negligence
  • Unauthorized modifications or repairs
  • Force majeure events
  • Normal wear and tear

8. Client Responsibilities

8.1
Site Access

Client must provide unobstructed access to the project site for our teams and equipment.

8.2
Documentation

Client must provide all necessary documentation including title deeds, identification, and KRA PIN for permit processing.

8.3
Safety Compliance

Client must ensure the site is safe for our personnel and comply with all safety instructions provided by our team.

9. Limitation of Liability

9.1
General Limitation

Our liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project.

9.2
Exclusions

We are not liable for:

  • Consequential or indirect damages
  • Loss of profits or business opportunities
  • Delays caused by third parties or regulatory bodies
  • Acts of God or force majeure events

10. Dispute Resolution

10.1
Negotiation

All disputes shall first be attempted to be resolved through good faith negotiation between the parties.

10.2
Mediation

If negotiation fails, parties agree to submit to mediation by a mutually agreed upon mediator.

10.3
Arbitration

Unresolved disputes shall be settled by arbitration in Nairobi, Kenya in accordance with the Arbitration Act of Kenya.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Kenya.

12. Amendments to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified Terms.
